2. Information We Collect

- Account Information: Login credentials, account preferences, and profile information.
- Business Data: Restaurant operational data including inventory, invoices, sales, and labor information that you input into the platform.
- SMS/Text Messaging Data: When a vendor opts in to receive purchase-order text messages from Marble, we collect the vendor's mobile phone number, the record of their consent, and any information exchanged via text message.
- Device and Media Data: With your permission, our mobile application may access your device's camera, microphone, and photo library to capture photos and videos of inventory, scan invoices, and enable voice-based input. Media files are uploaded to our secure cloud storage for processing.
- Push Notification Data: If you enable push notifications, we collect a device token to deliver notifications related to your account activity, such as order updates and task alerts. You can disable push notifications at any time through your device settings.
- POS Integration Data: If you connect a point-of-sale (POS) system to the Marble platform, we collect sales data, menu items, order information, and other operational data synced from your POS provider.
- Automatically Collected Data: Information collected automatically when you use our Service, including IP address, browser type, operating system, pages visited, features used, and time spent on the platform.
- Cookies and Tracking Technologies: We use cookies and similar technologies to collect information about your interactions with our Service, remember your preferences, and improve your experience.
- Communications: Records of your correspondence with us, including support requests and feedback.
3. How We Use Your Information
We use the information we collect to:
- Provide, maintain, and improve our Services.
- Process transactions and send related information.
- Send you service-related notices, updates, and administrative messages.
- Send SMS/text messages to vendors who have opted in, on behalf of our customers, to place and manage purchase orders.
- Send emails to vendors on behalf of our customers to communicate purchase orders, confirmations, and delivery coordination.
- Sync and process data from connected POS systems to provide sales analytics, demand forecasting, and operational insights.
- Deliver push notifications related to account activity, task updates, and order status.
- Respond to your requests, comments, and questions.
- Monitor and analyze usage trends to improve user experience.
- Detect, prevent, and address technical issues and security threats.
4. SMS/Text Messaging Program
Marble places and manages purchase orders with vendors (suppliers and distributors) on behalf of our restaurant customers through multiple channels, including email, vendor portals, direct API integrations, and SMS text messaging. For vendors who have opted in to SMS, Marble sends text messages to the vendor's phone number to communicate order details, confirm receipt, or coordinate delivery.
- Consent and Opt-In: Vendors opt in to receive text messages directly from Marble — either by confirming their consent on our opt-in page at joinmarble.ai/sms-optin (typically via a secure link), or by texting a start keyword to our number. A restaurant may invite a vendor to opt in, but Marble only sends transactional SMS messages to vendors who have themselves provided consent — consent is not transferred to Marble through the restaurant. Consent to receive text messages is not a condition of doing business with any Marble customer.
- Message Frequency: Message frequency varies based on purchasing activity. Vendors may receive messages each time a restaurant customer places or modifies a purchase order through the Marble platform.
- Opting Out: Vendors can opt out of receiving text messages at any time by replying STOP to any message received from Marble. After sending STOP, a final confirmation message will be sent, and no further messages will be delivered unless the vendor re-subscribes. We honor all standard opt-out keywords, including STOP, END, CANCEL, UNSUBSCRIBE, and QUIT. Vendors may also opt out by contacting us at support@joinmarble.com.
- Message and Data Rates: Message and data rates may apply. Check with your mobile carrier for details. Marble is not responsible for any charges incurred from your mobile carrier.
- No Sharing of SMS Data: We will not sell, rent, or share vendor phone numbers, SMS opt-in consent, or any data collected through our SMS program with any third parties or affiliates for their marketing or promotional purposes. We may share information with our SMS service provider solely for the purpose of delivering text messages on our behalf.
- Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages. Marble is not responsible for messages that are not received due to carrier network issues, device incompatibility, or changes to a mobile phone number.
5. How We Share Your Information
We do not sell your personal information. We may share your information in the following circumstances:
- Service Providers: We share information with third-party vendors who perform services on our behalf, such as hosting, analytics, payment processing, SMS delivery, and email delivery. These providers are contractually obligated to use your information only to provide services to us.
- POS Providers: When you connect a POS system, data is exchanged between Marble and your POS provider to sync sales, menu, and order information. This data sharing is governed by your agreement with your POS provider.
- Legal Requirements: We may disclose your information if required by law, regulation, legal process, or governmental request.
- Business Transfers: In connection with a merger, acquisition, or sale of assets, your information may be transferred as part of the transaction. We will notify you before your personal information is transferred and becomes subject to a different privacy policy.
- With Your Consent: We may share your information for other purposes with your explicit consent.
6. Data Retention
We retain your personal information for as long as your account is active or as needed to provide you with our Services. If you opt out of our SMS program, we will remove your number from our active messaging list within 5 business days. We retain records of opt-in consent and opt-out requests for compliance purposes. We may also retain certain information as required for legal compliance and dispute resolution.
We do not use any customer data, vendor data, or data from partner APIs to develop, improve, or train generalized AI and/or ML models.
You may request deletion of your personal data at any time by contacting us at support@joinmarble.com. We will respond to your request within 30 days.
7. Data Security
We implement industry-standard technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. This includes encryption of data in transit and at rest, access controls, and regular security assessments. However, no method of transmission over the Internet or electronic storage is 100% secure.
